These Terms of Service ("Terms") govern your access to and use of SendBeam (the "Service"), operated by STATUSAPP LTD ("we", "us"). By creating an account or using the Service you agree to these Terms.

1. Accounts
You must provide accurate account information and are responsible for activity under your account and for keeping your credentials secure. You must be at least 18 and able to form a binding contract.
2. Acceptable use
You agree not to use the Service to send email to recipients who have not consented to receive it, or to send unlawful, deceptive, or harmful content. Specifically, you will not:
- send unsolicited bulk email (spam) or use purchased/scraped lists;
- omit a functioning unsubscribe mechanism or a valid physical postal address;
- impersonate any person or organisation, or forge headers;
- distribute malware, phishing, or content that infringes others' rights.
We enforce sender reputation limits. We may pause or suspend sending that generates excessive bounces or spam complaints, to protect the Service and other customers.
The full rules — including the consent you must be able to evidence, the content and industries we restrict, and the bounce and complaint thresholds at which sending pauses — are set out in our Acceptable Use Policy, which forms part of these Terms.
3. Your content and lists
You retain ownership of the contact data and content you upload. You are responsible for having a lawful basis to process and email your contacts, and for honouring their unsubscribe and data requests. Our handling of personal data you upload is governed by our Data Processing Addendum.
Send history. We keep your send history — the record of which emails went to which contacts, and whether they were opened or clicked — for the life of your account. We do not delete it on a schedule. If a single workspace ever holds more than 10 million send events, we may remove events older than 24 months from that workspace, and we will tell you at least 7 days before we do. Nothing is removed without that notice. This does not apply to suppressions: a suppression is kept permanently and survives deletion of the contact it relates to, so that someone who has asked never to be emailed again cannot be re-imported by accident.
4. Plans, billing and limits
Paid plans are billed in advance on a recurring basis. Usage limits (emails and contacts) apply per your plan. Fees are non-refundable except where required by law. We may change pricing with reasonable notice.
5. Availability and changes
We aim for high availability but do not guarantee the Service will be uninterrupted or error-free. We may modify or discontinue features with reasonable notice where practical.
6. Termination
You may cancel at any time. We may suspend or terminate access for breach of these Terms. On termination you may export your data for a reasonable period, after which it may be deleted.
7. Disclaimers and liability
The Service is provided "as is". To the maximum extent permitted by law, we disclaim implied warranties, and our aggregate liability is limited to the fees you paid in the 12 months before the claim.
8. Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
